What changed in version 2.4 (30 September 2026)
- The only company in these Terms is Agent CS sp. z o.o., the technology company running the Application and the data controller. These Terms name no agency.
- “Casting Studio” is only the name of the Application. The Application is a multi-agency platform, and every agency has the same rights in it as the others.
- The Agency is the entity the Artist chooses. Representation, commission and exclusivity are governed solely by the Artist’s agreement with that agency. The Operator charges no commission and holds no exclusivity.
- Removed: the 20% commission in favour of the Operator or a named company, double and perpetual commission, the anti-circumvention clause, the 18-month AI exclusivity.
- An Agency sees only the Artists assigned to it. An application does not reach an agency the Artist did not name in it.
These Terms & Conditions set out the rules for using the Casting Studio mobile application and comply with the requirements of Polish law, Regulation (EU) 2016/679 (GDPR), the Act on the Provision of Electronic Services of 18 July 2002, the Consumer Rights Act of 30 May 2014, the Civil Code, the Apple App Store Review Guidelines, the Google Play Developer Program Policies, and other applicable regulations.

5.6. The Operator does not guarantee any results from use of the Application, including in particular obtaining a role, employment, contract, a specific number of profile views, casting matches, or any other professional or financial benefits.

6.1.2. The Operator is not an agency, does not provide Agency Services and is not a party to any agreement or agency relationship between an Artist and an Agency.
6.1.3. The Operator charges Artists no commission and acquires no exclusivity of any kind over an Artist.
6.2. Choice of Agency
6.2.1. The Artist may choose an Agency in the Application or in the application form.
6.2.2. The Artist’s representation, its scope, the Commission and any exclusivity are governed solely by the agreement between the Artist and the Agency the Artist has chosen. These Terms neither establish nor amend the terms of that agreement.
6.2.3. The provisions of these Terms concerning the Agency apply to an Artist who has chosen an Agency, and only with respect to that Agency.
6.3. Castings and applications

6.3.2. An Artist’s Profile is not presented to a Casting Client or to any other party unless the Artist has applied to the casting or project concerned.
6.3.3. An Agency sees in the Application only the Artists assigned to it. The materials of an application are not shared with an Agency the Artist did not name in that application, including where the Artist named another agency or none.
6.3.4. Project exclusivity. An Artist who applies to a project through a given Agency gives that Agency exclusivity for that project. The exclusivity covers that project only. Beyond it, these Terms establish no exclusivity.
6.4. Digital avatar (Digital Twin)
6.4.1. The Artist may consent to the creation of a digital avatar portfolio (the Digital Twin), a digital representation of their likeness, voice and/or movement, intended for use in projects using artificial intelligence (AI) technology, including content generation, advertising spots, animations and virtual productions.

6.4.3. The Operator acquires no exclusivity over the Digital Twin or over the Artist’s likeness, voice or movement.
6.4.4. The Artist may withdraw consent to maintaining the Digital Twin at any time. Withdrawal of consent does not affect the validity of licences granted to Clients before the date of withdrawal.
6.5. Liability
6.5.1. The Operator is not liable for the performance of agreements between the Artist and the Agency or between the Artist and a Casting Client, including payment of remuneration and settlement of the Commission. 7.4. Breach of the confidentiality obligation constitutes a material breach of these Terms and entitles the Operator to immediately suspend or delete the User’s account and to pursue compensation on general principles, including a contractual penalty in an amount separately determined by the Operator.
7.5. The confidentiality obligation applies throughout the period of use of the Application and for a period of 5 years after ceasing to use the Application or deleting the account.

8.2. The conditions for participation in workshops (price, dates, scope) are each time specified in a separate offer presented to the User before payment.
8.3. Completion of workshops does not guarantee profile approval, obtaining a casting role, or any other professional results. Workshops are of a purely educational and supporting nature. The Operator shall not be liable for the User’s failure to achieve expected results.
8.4. Materials created during workshops (photos, recordings) may be used by the User in their Application profile. The Operator retains the right to use such materials for promotional and marketing purposes of the Application, subject to the User’s right to object.
8.5. A refund for workshops is possible only where the workshops are cancelled by the Operator. If the User withdraws from participation, the payment is non-refundable, unless the withdrawal occurred at least 7 days before the scheduled workshop date. The Operator reserves the right to change dates, locations and instructors of workshops without any obligation to refund.

11. User Content and content licence
11.1. The User retains copyright to the Materials uploaded to the Application.
11.2. By uploading Materials to the Application, the User grants the Operator a free, non-exclusive, worldwide, irrevocable (for the term of the Terms), transferable licence with the right to sublicense to:

12.3. The User acknowledges and accepts that withdrawal of consent to the processing of image data by AI will prevent the use of the intelligent matching feature, which may significantly reduce the visibility of the User’s profile in casting search results. The Operator shall not be liable for reduced profile visibility resulting from the withdrawal of consent.
12.4. Image licensing for AI/CGI productions. On the basis of separate licence agreements, the User may consent to the use of their image and/or voice in productions employing AI/CGI technology. The terms of such agreements are negotiated individually and do not arise from these Terms.
12.5. With regard to AI-generated content, the Operator plans to implement the C2PA (Content Provenance and Authenticity) standard in order to mark metadata concerning origin, licences and consents.
12.6. The User acknowledges that results generated by AI systems (including matching recommendations, AI Assistant responses, generated descriptions) may contain inaccuracies, errors or imprecisions. AI results are of a purely informational and supporting nature. The Operator will endeavour to ensure the quality of AI results but does not guarantee their accuracy, completeness, usefulness, currency or fitness for a particular purpose. The User uses AI results at their own risk.
12.7. The Operator shall not be liable for decisions made by the User on the basis of results generated by AI systems, or for any damage (direct, indirect, incidental or consequential) arising from reliance on such results.

13.3. Breach of the acceptable use rules entitles the Operator to immediately suspend or delete the User’s account without notice and without any right to compensation. The assessment of whether a breach has occurred rests solely with the Operator.
14. User obligations
14.1. The User undertakes to:

The Operator is not responsible for the actions of casting clients as separate data controllers.
19.5. The User acknowledges that no IT system can guarantee 100% security of data transmitted over the Internet and uses the Application at their own risk in this regard. The Operator takes reasonable measures to secure data but does not guarantee its absolute security.
19.6. Access to the data of all Users in the Application is limited to persons authorised by the Operator, acting on its instructions (Article 29 GDPR). Membership in an Agency does not by itself give such access.
20. Communication and notifications
20.1. The Operator communicates with Users through:
-
push notifications in the Application;
-
e-mail messages;
-
in-app messages (banners, modals);

20.2. By accepting the Terms, the User agrees to receive transactional and service communications related to the operation of the Application (e.g. notifications about castings, statuses, changes to the Terms).
20.3. Marketing communication requires the User’s separate consent and may be withdrawn at any time.
20.4. The User is responsible for maintaining a current e-mail address and telephone number in the Application. The Operator shall not be liable for the non-delivery of communications caused by the provision of outdated contact details.
21. Force majeure
21.1. The Operator shall not be liable for the non-performance or improper performance of obligations arising from these Terms where caused by circumstances beyond the Operator’s reasonable control (force majeure), including but not limited to:
- natural disasters, epidemics, pandemics;
- armed conflicts, riots, strikes, lockouts;
- failures of telecommunications or power infrastructure;

- failures of payment service providers;
- embargoes, sanctions or other trade restrictions;
- other extraordinary and external circumstances that could not reasonably have been foreseen or prevented.
22. Changes to the Terms
22.1. The Operator reserves the right to amend these Terms in the event of changes to the law, supervisory authority recommendations, changes to the Application’s functionality, technological developments, or for other justified reasons.
22.2. The User will be notified of material changes to the Terms at least 14 days in advance via: push notification, e-mail, and an in-app banner.
22.3. Continued use of the Application after the changes take effect constitutes acceptance of the amended Terms. If the User does not accept the changes, they have the right to delete their account before the changes take effect.
22.4. Changes that do not materially affect Users’ rights and obligations (e.g. editorial corrections, changes to contact details) may be introduced without observing the 14-day period.
23. Dispute resolution and jurisdiction
23.1. Pre-litigation mediation. Before initiating any court proceedings, the User undertakes to attempt to resolve the dispute amicably with the Operator. To this end, the User is required to send a written complaint to: [email protected], describing the claim, its factual basis, and the requested form of redress. The Operator will respond to the complaint within 30 days. The parties will negotiate in good faith for a period of at least 60 days from the date of delivery of the complaint.
23.2. Institutional mediation. If the dispute has not been resolved through negotiation (Section 23.1), either party may, before filing a lawsuit, refer the matter to mediation conducted by the Mediation Centre at the Court of Arbitration at the Polish Chamber of Commerce (Krajowa Izba Gospodarcza) in Warsaw, in accordance with its Rules. The costs of mediation shall be borne equally by the parties.
23.3. Jurisdiction. All disputes arising from these Terms or related to the use of the Application shall be governed by Polish law and subject to the jurisdiction of the common courts competent for the Operator’s registered office (Warsaw), subject to mandatory consumer protection provisions that may grant the User the right to bring proceedings before the court competent for their place of residence.
23.4. Time limit for claims. All claims of the User against the Operator related to the use of the Application must be submitted in writing within 12 months from the date on which the User became aware, or should have become aware with due diligence, of the circumstances giving rise to the claim. After this period, claims shall expire to the fullest extent permitted by applicable law.
23.5. Class action waiver. To the fullest extent permitted by applicable law, the User agrees that all claims against the Operator shall be pursued on an individual basis only. The User waives the right to participate in class actions, group actions, or representative actions against the Operator.
23.6. Severability. If any provision of this section is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a provision closest to its economic purpose, to the extent permitted by law.

With regard to the version of the Application downloaded from the Apple App Store, these Terms constitute the end-user licence agreement (EULA) between the User and the Operator (not Apple Inc.). The Operator, not Apple, is solely responsible for the Application and its content. The licence granted to the User is limited to a non-transferable licence to use the Application on devices owned or controlled by the User, in accordance with the usage rules set out in the Apple Media Services Terms and Conditions.
24.3. In the event that the Application fails to conform to any applicable warranty, the User may notify Apple, and Apple may refund the purchase price of the Application (if applicable). To the fullest extent permitted by law, Apple bears no other warranty liability in respect of the Application.
